Terms and Conditions of Use

1. Acceptance of Terms

Welcome to iAd Properties. These Terms and Conditions of Use ("Terms") govern your access to and use of the iAd Properties website at www.iadproperties.co.zw and any related services (together, the "Platform"). Please read these Terms carefully.

By accessing, browsing or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.

2. Definitions

• "Platform" means the iAd Properties website and its services.
• "User", "You", "Your" means any individual or organisation that accesses or uses the Platform.
• "Agent", "Lister", "Seller", "Landlord", "Host" means a User who lists property for sale, rent or lease, or accommodation for booking, on the Platform.
• "Buyer", "Tenant", "Seeker", "Guest" means a User who searches for, enquires about or books property or accommodation on the Platform.
• "Content" means all information, data, text, photographs, graphics, messages and other material posted on the Platform.

3. User Accounts and Registration

• Eligibility: You must be at least 18 years old and able to enter into a binding contract to create an account.
• Account accuracy: You agree to give accurate, current and complete information when you register and to keep it up to date.
• Security: You are responsible for keeping your password safe and for everything done under your account. Tell us immediately about any unauthorised use.
• Account types: You may register as a private owner, buyer or tenant, accommodation host, agent, real estate company or property developer. Agents and real estate agencies must hold current registration with the Estate Agents Council of Zimbabwe (EAC) and may only publish listings once we have verified them.

4. Nature of Service

iAd Properties is an online marketplace where Users list, search for and connect about property and accommodation.

• Not a broker: We do not act as an estate agent for any User.
• Property sales, rentals and leases: These agreements, and any money paid under them, are solely between the parties. We are not a party to them.
• Verification: Agents and agencies must be registered with the Estate Agents Council of Zimbabwe (EAC) and are checked before they can list; private owners provide proof of ownership. We check what we can, but we cannot guarantee every detail in a listing.
• Stays booked online: For accommodation paid through the Platform, we collect the payment on the host's behalf (see section 7).

Always view a property and verify ownership documents before paying any money outside the Platform.

5. Listing and Content Policies

• Accuracy and responsibility: Listers are solely responsible for the accuracy, truthfulness and legality of their listings, including prices, descriptions, images and availability. You may only list property you own or are authorised to market, and you confirm you have the rights to all Content you post.
• Prohibited content: You agree not to post content that is false, misleading or fraudulent; infringes anyone's intellectual property; is defamatory, obscene or offensive; or breaks any law or regulation.
• Review: We may review, pause or remove listings that appear misleading or fraudulent.
• Licence to iAd Properties: By posting Content you give iAd Properties a worldwide, non-exclusive, royalty-free licence to use, display, reproduce and distribute it on the Platform and through other channels for marketing and operating the Platform.

6. Packages and Boosts

Packages and boosts are paid in US dollars through Paynow and are prepaid; they do not renew automatically. Fees are non-refundable once the package or boost starts. Paying does not guarantee enquiries, sales, bookings or approval of a listing. A new package replaces the current one immediately without credit for unused days. When a package ends, listings above the free limit are paused.

7. Stays Booked Online

When a guest pays for a stay, iAd Properties collects the payment on the host's behalf and passes it to the host, less the host's service commission shown on the booking, from the day after check-in. Guests pay a small service fee, shown before they pay. The host alone is responsible for the accommodation, its condition and safety, and the accuracy of the listing. A booking is confirmed only when paid; unpaid bookings are cancelled after the payment deadline.

Cancellation and refunds: each stay shows its host's cancellation policy, and a booking keeps the policy it was made under. Flexible: full refund (less the payment processing fee) up to the day before check-in; no refund on the day or for a no-show. Moderate: full refund 7 or more days before check-in; 50% refund 2–6 days before; no refund less than 2 days before or for a no-show. Strict: full refund 14 or more days before; 50% refund 7–13 days before; no refund less than 7 days before or for a no-show. If the host cancels, the guest receives a 100% refund. Refunds are sent to the guest by iAd Properties, usually within 3 working days.

8. User Conduct and Prohibited Activities

You agree not to:

• use the Platform for any unlawful purpose;
• harass, intimidate or harm other Users;
• use automated systems (bots, scrapers) to access the Platform or extract data without our permission;
• impersonate any person or organisation or misrepresent your affiliation with anyone;
• interfere with or disrupt the integrity or performance of the Platform.

9. Intellectual Property

The Platform, including its design, text, graphics, logos and software, belongs to iAd Properties and is protected by copyright and other intellectual property laws. You may not use our trademarks or logos without our prior written consent.

10. Disclaimer of Warranties and Limitation of Liability

• "As is": The Platform and all content are provided "as is" and "as available", without warranties of any kind, express or implied.
• Dealings between Users: iAd Properties is not liable for any direct, indirect, incidental, special, consequential or punitive damages resulting from your use of the Platform, dealings or agreements between Users, or your inability to use the Platform. For stays paid through the Platform, our liability is limited to the amount we collected for that booking.
• Third-party links: We are not responsible for the content or practices of third-party websites linked from the Platform.

11. Indemnification

You agree to indemnify, defend and hold harmless iAd Properties, its officers, directors, employees and agents from any claims, damages, obligations, losses, liabilities, costs or debt arising from your use of the Platform, your breach of these Terms, your breach of any third party's rights (including any property owner or agent), or any Content you post.

12. Termination

We may suspend or close your account and access to the Platform, with or without notice, for conduct we believe breaks these Terms or harms other Users, us or third parties.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Zimbabwe. Disputes arising from these Terms or your use of the Platform are subject to the exclusive jurisdiction of the courts in Harare, Zimbabwe.

14. Changes to These Terms

We may change these Terms. For material changes we will give at least 30 days' notice before they take effect. Continuing to use the Platform after the changes take effect means you accept them.
